This session will address key elements of today’s economic and regulatory environmental factors that have created the decrease in the number of PG’s over the past year. It will also address the unprecedented growth in the number of RRG’s. The panelists will also discuss the trends they believe are on the horizon and what factors from today’s environment will influence the decision whether or not to consider bearing risk.

The National Risk Retention Association has taken a lead role as a participant in litigation that has defined and interpreted the Liability Risk Retention Act of 1986. Since 1992, NRRA has participated as either an amicus curiae or plaintiff in almost every important discussion including the 9th Circuit National Warranty decision which the state of Oregon has petitioned for Supreme Court review. The panelists in this session will report on the history and current standing of our efforts to amend the LRRA. They will also discuss the legal and legislative activities of the NRRA Government Affairs Committee, as well as various court decisions of the past year. The discussion will include an opportunity for attendees to ask questions on how these decisions may affect your organization. The session will end with a discussion regarding potential challenges that may lie just over the horizon. In addition, time will be provided for attendees to express concerns they have or challenges that they face that might be taken into consideration by the NRRA’s Government Relations Committee.

Delos Smith is the Senior Business Analyst for The Conference Board (www.Conference-Board.org). He is an expert in fiscal policy, economic trends, taxation, the Federal budget process and U.S. economic indicators. He appears regularly on many major TV and radio networks, and addresses a wide variety of business and educational audiences around the world. He is a graduate of Colorado College.

NRRA General Session: Regulatory Perspective

tri As a product of federal legislation, Risk Retention Groups and Purchasing Groups enjoy a unique relationship in various states. This session will explore the unique aspects of this relationship from the perspective of state regulators. Also, explored in this session will be the National Association of Insurance Commissioners (NAIC’s) role and involvement in the evolution of this unique relationship. Special focus will be placed on current and emerging regulatory issues and trends.
